1. ABOUT SWITCHOFF

SwitchOff is an email marketing and follow-up automation service designed for small businesses.

SwitchOff allows users to manage contacts, create automated email journeys and send emails through their connected email account.

This Privacy Policy explains how SwitchOff collects, uses, stores and protects personal information when you use our website and service.

SwitchOff is operated by Ian Drummond, a sole trader trading as SwitchOff in the United Kingdom.

For personal information relating directly to SwitchOff account holders and visitors, SwitchOff acts as a data controller where applicable.

2. INFORMATION WE COLLECT

Depending on how you use SwitchOff, we may process:

  • Account information, such as your name, email address, business name and account identifiers.
  • Service settings, such as sending preferences, sending hours, timezone and other configuration.
  • Contact information you provide, including email addresses, names, organisations, telephone numbers, locations, notes and lifecycle/status information.
  • Email content, including email templates and Journey messages that you create or upload to SwitchOff.
  • Email sending information, including scheduled sending times, sending status, delivery information made available by the connected email provider and technical information needed to operate and troubleshoot email delivery.
  • Technical and website usage information, such as IP address, security logs, pages visited, referring website, approximate browser/device type, timestamps, and a pseudonymous daily visitor identifier used to understand use of the SwitchOff website.
  • Billing information may be processed if paid subscriptions are offered. Payment card details may be processed by our payment provider rather than stored directly by SwitchOff.

3. GOOGLE AND GMAIL DATA

SwitchOff can connect to a user's Google account so that emails can be sent using the user's own Gmail account.

SwitchOff requests only the Google permissions required to provide the features currently offered.

For the current version of SwitchOff, Gmail access is used to send email on the user's behalf.

SwitchOff does not use this permission to read the contents of the user's Gmail inbox.

Where necessary to maintain the connection, SwitchOff securely stores authentication credentials or tokens supplied through Google's authorisation process.

These credentials are used only to provide and maintain the Gmail functionality requested by the user.

SwitchOff's use and transfer of information received from Google APIs will comply with the Google API Services User Data Policy, including its Limited Use requirements.

SwitchOff does not sell Google user data.

SwitchOff does not use Google user data for advertising.

SwitchOff does not use Gmail data to build advertising profiles.

Google user data is not made available to third parties except where necessary to provide or secure the service, comply with law, or where the user has authorised the disclosure.

Users can disconnect their Gmail account from SwitchOff and may also revoke Google's authorisation through their Google Account.

4. HOW WE USE PERSONAL INFORMATION

We use information where necessary to:

  • create and operate SwitchOff accounts;
  • provide the features requested by users;
  • store contacts, Journeys, templates and settings;
  • schedule and send emails requested by users;
  • maintain connections to supported email services;
  • provide customer support;
  • understand service usage and improve it using minimal server-side operational totals and retained historical website analytics (new additional browser-based marketing tracking is disabled; SwitchOff does not add third-party advertising trackers or store raw IP addresses in its website analytics records);
  • prevent abuse and protect the security and reliability of SwitchOff;
  • administer subscriptions and payments where applicable;
  • comply with legal obligations; and
  • improve the operation and usability of the service.

We do not sell personal information.

Access to customer content is not routine monitoring. Authorised personnel may access relevant account content only when reasonably necessary to provide requested support, investigate abuse or security incidents, enforce our Terms, or comply with law.

5. CONTACTS UPLOADED BY SWITCHOFF USERS

SwitchOff users may upload or enter information about their own customers, prospects and other contacts.

For this information, the SwitchOff user generally determines why the information is being processed and which communications should be sent.

The user is responsible for ensuring that they have an appropriate lawful basis for processing the information and that their communications comply with applicable privacy, data protection and electronic marketing laws.

Where SwitchOff processes this information solely to provide the service on the user's instructions, SwitchOff acts as a processor on behalf of that user.

6. MARKETING EMAILS SENT USING SWITCHOFF

SwitchOff provides technology that enables users to send their own communications.

Users are responsible for the recipients they add to SwitchOff and the messages they instruct SwitchOff to send.

Users must comply with applicable laws including, where relevant, the UK GDPR, Data Protection Act 2018 and Privacy and Electronic Communications Regulations (PECR).

Different rules may apply depending on the recipient and the circumstances of the communication.

Recipients' objections, opt-outs and withdrawals of consent must be respected.

7. SUPPRESSION AND OPT-OUT INFORMATION

SwitchOff provides functionality allowing users to stop communications to a contact.

Certain suppression information may need to be retained so that an opted-out or suppressed contact is not accidentally added back into active marketing.

Users must not deliberately circumvent suppression or opt-out controls.

8. HOW LONG WE KEEP INFORMATION

SwitchOff’s additional browser-based marketing measurement is disabled. It does not collect new pageviews, clicks or browsing identifiers, and does not set analytics cookies, use fingerprinting or add tracking pixels. Stored preferences and session identifiers from that former measurement are removed when the updated application loads. Anonymous website visits cannot be reliably counted or linked to signups through this disabled measurement.

We separately use minimal account-operation records to understand trial activation and subscriptions, relying on our legitimate interest in operating and improving SwitchOff. These totals are not linked to anonymous browsing histories. Analytics contain no email addresses, raw IP addresses, Gmail credentials, message contents or full referring URLs. Previously collected anonymous browser measurements retain their existing window of up to 90 days and new account milestone facts up to one year, with expired records removed on subsequent analytics processing. Existing historical pageview records remain separately retained for trend comparisons. Owner and identified test/demo activity can be excluded from reporting without changing customer records. We do not put tracking pixels, click redirects or tracking links into marketing emails.

Existing hosting-platform analytics are separate and unchanged. Historical first-party records remain available under their existing retention rules; they are not a count of current visitors or verified unique people.

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, to provide the service, meet legal requirements and resolve disputes.

Users can delete contacts and other information using available SwitchOff controls.

When an account is deleted, SwitchOff will delete or anonymise associated personal information where reasonably possible, subject to information that must temporarily or permanently be retained for security, legal, fraud-prevention, backup or suppression purposes.

9. SERVICE PROVIDERS

SwitchOff uses third-party service providers where necessary to operate the service.

These may include providers of:

  • cloud application hosting and infrastructure;
  • databases and storage;
  • authentication;
  • email connectivity;
  • payment processing; and
  • operational or security services.

These providers may process information only as necessary for their respective functions and subject to applicable contractual and legal safeguards.

Where information is transferred internationally, appropriate safeguards required by applicable data protection law will be used where required.

10. SECURITY

We use reasonable technical and organisational measures designed to protect personal information against unauthorised access, loss, misuse or alteration.

No online service can guarantee absolute security.

Users are responsible for protecting their own account credentials and should notify us promptly if they believe their account has been compromised.

11. YOUR RIGHTS

Depending on the circumstances, UK data protection law may give you rights including:

  • access to your personal information;
  • correction of inaccurate information;
  • deletion of information;
  • restriction of processing;
  • objection to processing;
  • data portability; and
  • withdrawal of consent where processing is based on consent.

You have the right to object to the use of your personal information for direct marketing.

To exercise a right concerning information controlled directly by SwitchOff, contact:

support@switchoff.today

Where your information has been entered into SwitchOff by one of our customers, you may need to contact that business directly because it determines how your information is used.

You also have the right to complain to the UK Information Commissioner's Office.

12. CHILDREN

SwitchOff is a business service and is not intended for use by children.

13. CHANGES TO THIS POLICY

We may update this Privacy Policy as SwitchOff develops or where legal or regulatory requirements change.

Material changes will be communicated where appropriate, and the current version will always be published on our website.
